Privacy Policy for the use of the Campbell Gray Hospitality application

Status May 2024

With this data protection declaration, the Campbell Gray Hospitality as the responsible party explains to you for which purposes and to what extent personal data is collected when using the Campbell Gray Hospitality app, processed and used.

We, the operators of the Campbell Gray Hospitality app, treat the personal data processed as a result of using the app confidentially and in compliance with the relevant data protection regulations.

By downloading the app, you confirm acknowledgment of the data collection, processing, and use procedures described in detail below.

Data processing during download and installation of the app

To be able to purchase and install an app through which we make content available to you, you may have to enter into a usage agreement with a third-party provider. When you download the app, the necessary information is transferred to the App Store or Play Store, including, your username, email address and customer number or your account, payment information, the time of the download and the individual device identification number. We do not influence this data collection and are not responsible for it. We only process the data insofar as it is necessary for downloading the app to your mobile device. You can find further information in the privacy policy of the third-party provider.

Data processing by Campbell Gray Hospitality

Any personal data obtained by Campbell Gray Hospitality through your use of the Campbell Gray Hospitality App will be used solely for the purpose of operating the App and for communication and direct marketing purposes in connection with products and events.

Some data that your browser transmits to our server is automatically collected. This is done to display the app to you and to ensure the necessary stability and security (legal basis is Art. 6 para. 1 lit. f DSGVO) and concerns the following data:

The following system queries may be carried out on your mobile end device by installing the app. It depends on which services are used within the app:

After app installation, to be informed about local offers, you can give and freely revoke your consent to release your mobile device location data at any time.

Beacon technology is used for this purpose when you come near one of our stores or are in the store. Beacons are transmitters based on BLE technology (“Bluetooth Low Energy”) that transmit a signal to receivers such as mobile end devices. As soon as a receiver comes within range of a transmitter, the receiver can identify the transmitter (the beacon).

We will never track your location without your consent. Before you wish to use a location-based content or service within the app for the first time, your mobile device will ask you for permission to do so. If you do not give your permission, we will not process any location-based content data. In this case, we ask for your understanding that we will then also not be able to offer the location-based service.

We do not store your location data permanently, but only for as long as, and to the extent necessary to process the location-based content or service request. In the device setting of your smartphones, you can withdraw consent to the collection of location-based information at any time.

The information in your user profile is provided solely to filter the entirety of the offers posted in the app concerning your interests and needs and is voluntary.

Use of the data collected by us during registration

If you wish to register on our app under our terms of use, we will request the following data about you via our input mask:

These data queries are necessary in each case to be able to offer you our services under our terms of use. The legal basis for this is Art. 6 para. 1 lit. b DSGVO.

The data will be stored as long as your registration is valid. Legal storage obligations, for example, due to commercial or tax law requirements, remain unaffected.

If we use external service providers to process personal data, these service providers have been carefully selected, commissioned in writing, and are bound by our instructions. The service providers will not pass this data on to third parties but will delete it after the contract has been fulfilled and the statutory storage periods have been completed unless consent has been given to store it beyond this.

Your registration details are stored in your account and saved on the servers.

In addition, certain data may also be stored on your mobile device.

Disclosure to third parties

We will only share your personal data with other parties such as companies and external persons if there is legal permission to do so.

In addition, we can track you in a store using the above-mentioned beacon technology if you permit us to do so.

The analysis service is used exclusively based on your consent, which you can give via our Consent Management Tool and revoke at any time.

Insofar as personal data is transferred to Switzerland within the scope of the use of the service, an adequacy decision of the European Commission exists for this third-party country transfer. We have concluded an order processing agreement with beaconsmind.

Sentry

Our app uses the error diagnosis service Sentry, which is operated by Functional Software, Inc., 1501 Mariposa St #408, San Francisco, CA 94107, USA. If the app crashes during use or if unexpected errors occur, specific information, namely end-device information such as installer ID and IP address as well as device type, operating system version, date and time of the error, the country from which the query takes place, and the set language of the operating system is sent to Sentry. This data is transmitted to the servers of the processor in the USA. The legal basis for this is the standard contractual clauses of the European Commission. For more information, please see Sentry’s privacy policy: https://sentry.io/privacy/.

Your Rights

You have the following rights vis-à-vis us under the respective legal conditions regarding the personal data concerning you:

Please contact support@beaconsmind.com for all inquiries regarding data protection law.

You also have the right to complain to a data protection supervisory authority about our processing of your personal data.

Use of your email address and postal address

During your registration with acceptance of the terms of use, you have the option of giving us your separate consent to receive e-mail and postal newsletters. Thus, we process your e-mail address and postal address to send you corresponding e-mails and postal items. You can revoke this consent at any time without giving reasons.

Links to other websites

The app may link to websites of other providers not affiliated with us (third parties). When you click on these links, we no longer have any influence on which data is collected and used by these providers. More detailed information on data collection and use can be found in the privacy policy of the respective provider. Since the collection and processing of data by third parties is, by nature, beyond our control, we do not accept any responsibility for this.

Data security

You are responsible for controlling access to your mobile device. This includes keeping your password confidential and not sharing it with anyone. You are also responsible for informing the beaconsmind AG or the partner concerned if you suspect that information in the app has been accessed without authorization. The beaconsmind AG employs technical and organizational security measures to ensure that users’ personal data is protected against loss, inaccurate changes, or unauthorized access by third parties. Furthermore, in any case, only authorized persons have access to your personal data from our side, and this is also only insofar as it is necessary within the scope of the above-mentioned purposes. As far as necessary, the beaconsmind AG data provides a so-called “Secure Sockets Layer” (SSL) transmission. All information transmitted using this secure method is encrypted before it is sent to us. In this way, this data cannot be read by unauthorized persons during transmission on the Internet.

Nevertheless, we would like to point out that data transmission on the Internet (e.g., when communicating by email) can have security gaps. Complete protection of data access by third parties is therefore not possible.

Update of the data protection notice

Since this data protection notice may change from time to time as a result of legal changes or new functions within the scope of our offer, we recommend that you check it regularly.
